How much will I have to Pay Clark and Washington to Represent Me for a Chapter 7 or 13 Bankruptcy?

Naturally, one of the first questions we field at Clark & Washington where filing a Chapter 7 or Chapter 13 Florida bankruptcy is concerned is “how much will it cost me to hire your firm to represent me in bankruptcy court?” With either type of bankruptcy, there are attorney’s fees and court filing costs involved. The following is the breakdown between the two where both types of bankruptcies are concerned.

Chapter 7 Filing Fees

There are two fees involved where filing fees are concerned – the $299 federal court filing fee and the $50 credit counseling certificate fee. The $50 fee includes pre-filing and pre-discharge counseling fees. Additionally, if you choose to do so, you can pay $20 for a single credit report or $40 for a joint one.

Chapter 7 Attorney’s Fees

For routine (standard) Chapter 7 cases, our Clark & Washington Orlando bankruptcy attorneys charge $1,450. We do offer terms if you cannot afford a lump sum payment. Once you have paid your filing fees, (see above), we can file your Chapter 7. Additionally, we can make payment arrangements for a 5-month payoff of your attorney’s fees. However, you can pay your attorney’s fees in full using cash, check, and debit card, money order, or a 3rd party check should you desire to do so.

In roughly 90% of the cases, our standard $1,450 fee applies but it can vary either down or up depending on certain factors such as:

  • amount of debt
  • amount and type of assets involved
  • number of properties and/or real estate owned
  • type of debts (secured, unsecured, etc.)
  • whether there are priority or stale taxes involved

Chapter 13 Filing Fees

There is a $274 federal court filing fee and the $50 credit counseling certificate fee (see above) for a total of $324.

Chapter 13 Attorney’s Fees

When you file a Chapter 13, the attorney’s fees incurred are attached as part of your repayment plan. The trustee assigned to the case will pay your attorney’s fees along with making payments to your creditors each month. Clark & Washington will make every effort possible to minimize your costs and begin your case. In most cases, we can file your Chapter 7 or 13 petition for just the cost of the filing fee.
